Below is a list of land regulations which are in the process of being developed, reviewed, or revised by the Department.

Regulation TitleOil Pollution and Tank Management
PurposeRevising the Department regulations related to underground storage tanks (USTs) to comply with current federal UST regulations, to remove obsolete language, and update current practices.

Relevant Statutory DeadlineOctober 13, 2018 is the federal deadline to apply for State Program Approval. Regulations need to be in place as part of the application process.

ProgramSolid Waste Program
Regulation TitleSolid Waste Management
PurposeA review of the Department’s solid waste management regulations, pursuant to State Government Article, §§10-130—10-139, revealed the need to update these regulations due to changes in various statutes and cited regulations, and the Department's desire to incorporate some elements of 40 CFR Part 258, the federal regulations governing municipal solid waste landfills.

StatusThe Land Management Administration is in the process of inventorying and evaluating the needed changes. We will be assembling a workgroup to explore proposed areas of regulatory change and to help develop regulatory language. The changes are needed to bring the state's regulations into conformance with federal regulations regarding municipal waste landfills that have been in effect since 1991 and to include state statutory changes that have taken place over the last 20 years.

Regulation TitleBeneficial Use of Coal Combustion Byproducts (New Chapter)
PurposeThese regulations are being developed to address the use and recycling of coal combustion byproducts.

StatusProposed regulations were published in the Maryland Register on February 26, 2010. The period in which to adopt those proposed regulations has expired. A new proposal is being developed but is delayed pending the promulgation of revisions to existing management of coal combustion byproducts regulations at COMAR 26.04.10, which is currently in process.

Hazardous Waste Land Disposal Restrictions
Purpose
Incorporates Federal land disposal restrictions program for hazardous waste into State regulations. EPA is implementing their own rules.

ProgramResource Management Program
Regulation TitleMixed Waste Rulemaking
PurposeConditionally exempts mixed waste (waste that is regulated as hazardous waste and is also radioactive) from most hazardous waste regulations provided it is managed in accordance with Nuclear Regulatory Commission regulations.

Regulation Title
Hazardous Waste Identification Rule – Contaminated Media and Debris
Purpose
Establishes a Department approved remedial action plan as a form of permit when operations involved in cleaning up a contaminated site would otherwise trigger permit requirements for hazardous waste treatment or disposal.

ProgramResource Management Program
Regulation TitleStorage, Collection, Transferring, Hauling, Recycling, and Processing of Scrap Tires
PurposeTo update and modernize the existing regulations on scrap tire management in the state. Revisions to these regulations will include changes to the terms for scrap tire licenses and approvals, updates to the scrap tire licenses and approvals application requirements, creation of a scrap tire hauler exemption, reduced reporting requirements, and other clarifying and formatting changes.

ProgramSolid Waste Program
Regulation TitleRecycling Facilities (New Chapter)
PurposeAs required under Ch. 376 of 2017, to develop regulations for recycling facilities that clarify when a refuse disposal permit is or is not required, exempt certain materials managed at a recycling facility from being designated as solid waste, and to establish other requirements and approvals for recycling facilities. These regulations will be adopted under a new chapter.

StatusThe meetings of the Solid Waste and Recycling Facilities Workgroup have concluded, which consisted of affected stakeholders consulted in the development of the regulations. The proposal is being drafted.

ProgramSolid Waste Program
Regulation TitleManagement of Coal Combustion Byproducts
PurposeTo make the changes needed to the existing regulations governing coal combustion byproducts (or coal ash), due to the promulgation of federal regulations governing coal combustion residuals disposal that became effective in October 2015.

Relevant Statutory DeadlineFederal regulations encourage incorporation within 18 months of October 19, 2015. However, the U.S. EPA is proposing and adopting revisions to the 2015 federal coal combustion residuals disposal regulations.
